  • Merchant Account Data: Information provided directly by business owners, managers, or staff, including names, mobile phone numbers, corporate email addresses, business account registration details, outlet industry sectors, and subscription billing information.
  • Service Utilization Data: End Customer names, mobile numbers, queue entries, reservations, or digital stamp/point logs processed through the system (depending on the specific services activated by the Merchant).
  • Automatically collected information: General technical and device information, browser type, or similar tracking technologies used to ensure system stability and performance.
  • Information shared with us by other users: For example, when a user books a queue spot or reservation for someone else, they confirm that they have obtained that individual's explicit consent.

2. Data Roles and Governance

To clarify data ownership under the PDPA:
  • Jomqueue as a Data Controller: We control personal data related directly to Merchant accounts, corporate communication, and platform subscription administration.
  • Jomqueue as a Data Processor: We act strictly as a technical service provider when handling End Customer transactional details (such as phone numbers entered to join a queue or track stamps). The respective Merchant remains the Data Controller for their consumer records.

3. How We Use Your Information

We process personal data strictly for legitimate business operations under the following frameworks:
  • To Provide the Services: Generating digital queue positions, maintaining accurate internal loyalty stamp/point ledgers for Merchants, and processing subscription transactions.
  • Automated Communications: Transmitting real-time queue status updates, proximity reminders, countdown alerts, and reward accumulation summaries via SMS or WhatsApp.
  • System Optimization: Analyzing anonymous, aggregated performance data to improve server response times, fix software bugs, and optimize user experience.
  • Legal Compliance: Satisfying statutory obligations under Malaysian tax laws (LHDN), corporate governance, or responding to valid regulatory directives.

4. Sharing and Disclosure

We do not sell, rent, or trade personal data to third-party marketing companies. Personal data is disclosed only to the following entities:
  • Between End Customers and Merchants: End Customer mobile numbers and waitlist/stamp records are securely shared with the specific Merchant whose establishment the customer is visiting, solely to facilitate business workflow.
  • Trusted Third-Party Infrastructure Providers: Cloud hosting servers, database maintenance entities, and telecommunication/messaging API gateways (such as Meta/WhatsApp API providers) acting strictly as sub-processors under strict confidentiality terms.
  • Legal & Law Enforcement Authorities: When mandated by a court order, statutory regulation, or a government enforcement body operating within Malaysia.

5. Security of Your Information

We implement reasonable technical, administrative, and organizational measures, such as encryption, network security, and restricted access controls, to protect personal data from loss, misuse, or unauthorized access.

6. Data Retention

We retain personal data only for as long as necessary to fulfill the operational purposes outlined in this policy.
  • Active queue transactional data is automatically cleared or anonymized regularly.
  • Merchant account records and historical End Customer loyalty/stamp ledgers are maintained continuously until a formal account termination or data erasure request is finalized.

7. Cookies and Third-Party Services

We may use basic cookies to optimize platform performance and ensure system stability. Additionally, our Services integrate with third-party messaging providers (such as WhatsApp/SMS gateways) to deliver real-time notifications. We are not responsible for the independent privacy practices of these third-party platforms.

8. Your Privacy Rights

In accordance with the PDPA, you have the right to access, copy, correct, or update inaccurate or incomplete personal data, or to withdraw your consent to future processing. Requests regarding data controlled directly by Jomqueue can be sent to our contact email and will be addressed within the statutory 21-day window. End Customers seeking the deletion of their lifetime loyalty stamp history must direct their requests to the respective Merchant.

9. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in practices, legal requirements, or other circumstances. Updates will be posted on our Website with the "Last Updated" date. Continued use of the Services constitutes acceptance of the revised Privacy Policy.
